By using MealApp you agree to these terms. Please read them carefully before placing an order, making a reservation, or using any feature of the platform.
Who We Are
MealApp is a digital platform that connects users with restaurants and food businesses operating in Belgium. Through MealApp, users can browse menus, place orders, make reservations, and leave reviews.
Acceptance of Terms
By creating an account, placing an order, making a reservation, or otherwise using MealApp, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions, our Privacy Policy, and our Cookie Policy.
If you do not agree to these terms, you must stop using MealApp immediately. MealApp reserves the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the revised terms.
These Terms are available in English. In case of any conflict between translations, the English version shall prevail. Belgian law applies to all aspects of this agreement.
Eligibility & Age Requirements
MealApp is open to all users. However, certain products available on the platform are subject to age restrictions under Belgian law:
- Alcoholic beverages: you must be at least 18 years old to order alcohol. By placing an order containing alcoholic products, you confirm you are 18 or over
- Tobacco products: you must be at least 18 years old to order any tobacco or nicotine products
- Any other age-restricted product listed on the platform: the minimum age will be clearly indicated on the product page
Scope of Service
MealApp operates exclusively in Belgium and provides the following services:
- Food ordering: browse menus and place delivery or takeaway orders from partner restaurants
- Delivery: MealApp offers its own delivery service, or restaurants may handle delivery themselves depending on the commission plan selected
- Table reservations: book a table at partner restaurants directly through the app
- Reviews & ratings: read and submit reviews and photos for restaurants listed on MealApp
- Discovery: explore nearby restaurants, filter by cuisine, price, and availability
Placing an Order
When you place an order through MealApp, you are entering into a contract directly with the restaurant — not with MealApp. MealApp facilitates the transaction as an intermediary.
Once you submit an order:
- You will receive an order confirmation via email and/or in-app notification
- The restaurant has the right to accept or reject your order within a reasonable time
- If the restaurant rejects your order, any payment will be fully refunded
- Estimated delivery or pickup times are indicative and may vary due to demand or other factors
MealApp cannot guarantee the accuracy of menu descriptions, ingredient lists, or allergen information provided by partner restaurants. Always inform the restaurant directly of severe allergies.
Allergens & Dietary Requirements
MealApp allows users to indicate allergies and dietary requirements in order notes. This information is passed on to the restaurant. However, MealApp cannot guarantee that:
- Restaurants will be able to accommodate all dietary requirements
- Cross-contamination will not occur in restaurant kitchens
- All allergen information displayed on the platform is complete and up to date
Payments
All payments on MealApp are processed securely through Stripe, a PCI-DSS certified payment provider. MealApp does not store or have access to your full card details.
- Payment is charged at the time of order confirmation
- All prices displayed are in Euros (€) and include applicable VAT
- Any applicable service fees or delivery fees will be clearly displayed before checkout
- You pay per order — there are no subscription fees for users on MealApp
In case of a failed payment, your order will not be processed. Please check your payment method and try again or contact your bank.
Bill Splitting
MealApp allows users to split the cost of an order between multiple people. When using the bill splitting feature:
- The user who creates the order is the group organiser and is responsible for initiating the split and sharing the payment link with the other participants
- Each participant pays their share independently and securely through Stripe
- The order is only confirmed and sent to the restaurant once all shares have been paid within the time limit shown at checkout
- If one or more participants do not pay within the time limit, the organiser will be notified and may choose to cover the remaining amount or cancel the order
- If the order is cancelled due to incomplete payment, any shares already paid will be refunded as MealApp wallet credit
Group Reservations & Deposits
For restaurants that integrate MealApp's booking widget directly on their own website, the restaurant manager may configure a deposit requirement for large group reservations. The following rules apply:
- The deposit threshold (minimum number of guests) and deposit amount are set entirely by the restaurant manager — MealApp does not impose any fixed rules
- The restaurant may also choose not to require any deposit at their discretion
- The deposit amount is charged at the time of booking confirmation and is deducted from the final bill at the restaurant
- If the reservation is cancelled within the restaurant's free cancellation window, the deposit will be refunded as MealApp wallet credit
- If the reservation is cancelled outside the free cancellation window or in case of a no-show, the deposit may be retained by the restaurant according to their stated cancellation policy
Gift Cards
MealApp offers digital gift cards that can be purchased and used on the platform. The following terms apply to all MealApp gift cards:
- Gift cards can be purchased directly through the MealApp app or website
- Gift cards never expire — the balance remains available indefinitely
- Gift cards can be used partially — if your order total is less than the gift card balance, the remaining credit is kept on the gift card for future use
- If your order total exceeds the gift card balance, you can pay the difference with another payment method
- Gift cards can be redeemed on any order placed through MealApp in Belgium
- Gift cards cannot be exchanged for cash, refunded, or transferred to another account once activated
- MealApp is not responsible for lost, stolen, or unauthorised use of gift card codes — treat your gift card code like cash
Cancellations, Refunds & Right of Withdrawal
Under EU consumer law (Directive 2011/83/EU), you generally have a 14-day right of withdrawal for online purchases. However, this right does not apply to food orders once preparation has begun, as they are perishable goods (Art. 16(d) of the Directive). This exception is expressly acknowledged by you when placing an order.
- Before restaurant acceptance: you may cancel your order at no charge
- After restaurant acceptance: cancellations are at the restaurant's discretion and may not be eligible for a refund, as food preparation may have already started
- Wrong or missing items: if your order arrives incorrect or incomplete, contact MealApp support within 24 hours
- Restaurant cancellations: if the restaurant cancels your order, a full refund will be issued automatically
All approved refunds are credited to your MealApp wallet and are available immediately for use on your next order. Refunds are not returned to the original payment method.
Delivery Service
MealApp offers its own delivery service for orders placed through the platform. Riders receive and manage deliveries through the dedicated MealApp Rider App. Depending on the commission plan selected by the restaurant, delivery may be handled by:
- MealApp delivery (25% or 15% plan): MealApp assigns the order to an available rider via the MealApp Rider App and manages the entire delivery process on behalf of the restaurant
- Restaurant delivery (13% plan): the restaurant handles delivery using their own private fleet of riders
In all cases, MealApp is not liable for:
- Delays caused by traffic, weather, or high demand
- Food temperature or condition upon arrival when delivered by the restaurant
- Damage occurring during transport outside of MealApp's direct control
Estimated delivery times are approximate. If your order is significantly delayed or not delivered, contact us at team@mealapp.app.
Table Reservations
MealApp allows users to book tables at participating restaurants. When you make a reservation:
- You will receive a confirmation email and/or in-app notification
- The reservation is a direct agreement between you and the restaurant
- MealApp acts solely as the booking intermediary
Cancellation policy: cancellation terms vary by restaurant and will be shown before you confirm the booking. In general:
- Cancellations made more than 24 hours in advance are typically free of charge
- Late cancellations or no-shows may result in a fee charged by the restaurant
- Repeated no-shows may result in suspension of your booking privileges on MealApp
Reviews, Ratings & Photos
Verified users may leave reviews, ratings, and photos for restaurants they have ordered from or visited. By submitting any content, you agree that:
- Reviews and photos must be honest, fair, and based on your genuine personal experience
- You will not post defamatory, offensive, discriminatory, or false content
- You will not post reviews or photos in exchange for compensation, discounts, or any benefit
- Photos must not contain personal data of third parties without their consent
- Photos must not infringe third-party intellectual property rights
- You grant MealApp a non-exclusive, royalty-free, worldwide licence to display, reproduce, and use your review and photos on the platform and in marketing materials
MealApp reserves the right to remove any review or photo that violates these guidelines without prior notice. Systematic abuse may result in account suspension.
User Accounts
To use MealApp's full features, you must create an account. You are responsible for:
- Providing accurate, complete, and up-to-date information during registration
- Keeping your login credentials confidential and not sharing them with others
- All activity that occurs under your account
- Notifying MealApp immediately if you suspect unauthorised access to your account
MealApp reserves the right to suspend or permanently delete accounts that violate these Terms, engage in fraudulent activity, or abuse the platform.
Prohibited Conduct
When using MealApp, you agree not to:
- Place fraudulent, fake, or abusive orders
- Order age-restricted products while being under the legal minimum age
- Attempt to manipulate prices, reviews, or restaurant rankings
- Use automated tools, bots, or scrapers to access the platform
- Impersonate another person or entity
- Violate any applicable Belgian or EU law or regulation
- Harass, threaten, or abuse restaurant staff, delivery personnel, or MealApp staff
- Post or transmit any harmful, offensive, or illegal content
- Upload photos containing illegal content or infringing third-party rights
Violations may result in immediate account suspension and, where applicable, legal action.
Becoming a Partner Restaurant
Restaurants can apply to become a MealApp partner through MealApp Manager, our dedicated partner portal available on our website. By registering as a partner, restaurants agree to:
- Provide accurate business, menu, and allergen information
- Comply with all applicable Belgian food safety, hygiene, and licensing regulations
- Accept and process orders within a reasonable time
- Honour the prices and offers displayed on the platform
- Maintain the quality standards expected by MealApp users
- Verify the age of customers ordering age-restricted products at the point of delivery
MealApp reserves the right to suspend or remove any partner restaurant that fails to meet these standards, receives consistently poor reviews, or violates applicable law.
Commission Plans
MealApp charges partner restaurants a commission on each order processed through the platform. The commission is calculated on the total order value selected by the customer (excluding applicable taxes). Restaurants choose their plan during onboarding on MealApp Manager and can change it with 30 days' notice.
Three plans are available:
To summarise: the 25% plan means MealApp takes care of everything including delivery at no extra cost to the restaurant. The 15% plan includes MealApp delivery but the restaurant contributes to the delivery cost. The 13% plan is for restaurants that have their own delivery fleet and handle all deliveries independently.
Restaurant Payouts
All payments made by customers on MealApp are collected by MealApp Technologies BV on behalf of the partner restaurant. MealApp acts as the payment collection agent and disburses the funds to restaurants according to the following schedule:
- All order revenues generated between day 1 and day 31 of each calendar month are collected and held by MealApp
- On the 5th of the following month, MealApp transfers the total revenue — minus the applicable commission — to the restaurant's registered bank account
- If the 5th falls on a weekend or Belgian public holiday, the transfer will be processed on the next working day
- For example: all orders placed in January are paid out to the restaurant on 5 February (or the next working day)
🏦 Payouts are processed via bank transfer to the IBAN provided during onboarding on MealApp Manager. Restaurants are responsible for keeping their banking details up to date.
MealApp will provide a monthly earnings statement through MealApp Manager detailing all orders, commissions deducted, and the net amount paid out. In case of disputes regarding payouts, restaurants must contact team@mealapp.app within 15 days of the payout date.
Restaurant Responsibility
Partner restaurants are independent businesses solely responsible for:
- The quality, safety, and accuracy of the food and menu information they provide
- Compliance with all applicable Belgian food safety and hygiene regulations
- Accurate allergen and ingredient disclosure
- Timely preparation and handover of orders to MealApp delivery or their own couriers
- Age verification at delivery for restricted products
- Handling complaints related to food quality directly with the customer
MealApp acts in good faith to list only reputable restaurants but cannot guarantee the conduct or quality of any individual partner.
Rider Status & Legal Relationship
Riders who perform deliveries for MealApp operate as independent self-employed contractors, not as employees of MealApp Technologies BV. This means:
- Riders are free to choose when and how often they work — there is no obligation to accept any specific order
- MealApp does not impose fixed working hours or an exclusive working relationship
- Riders are responsible for their own tax declarations, social security contributions, and compliance with Belgian self-employment regulations
- The relationship between MealApp and a rider does not constitute an employment contract under Belgian labour law
Rider Registration & Requirements
To register as a rider on MealApp, applicants must create an account on the MealApp Rider App and provide the following documents:
- Valid identity document (national ID card or passport)
- Proof of self-employed status (CBE/KBO registration number)
- Valid driving licence appropriate for the vehicle used — required for scooter, motorbike, or car only (no licence required for bicycle under Belgian law)
- Proof of vehicle insurance covering third-party liability — required for scooter, motorbike, and car; recommended for bicycle
- Vehicle registration document (for scooter, motorbike, or car only)
MealApp reserves the right to reject or suspend a rider's account if the documents provided are incomplete, expired, or found to be fraudulent.
Rider Payments
Riders are compensated on a per-delivery basis. A fixed fee is assigned to each completed delivery, which may vary based on distance, time of day, and demand in the area.
- Earnings are automatically tracked and recorded in the MealApp Rider App
- Payments are made every week, covering all deliveries completed in the previous 7-day period
- Payouts are transferred via bank transfer to the IBAN registered in the rider's account
- Riders are responsible for issuing invoices to MealApp for the amounts earned, in accordance with Belgian self-employment regulations
- MealApp will provide a weekly earnings summary through the Rider App as a reference for invoicing
Rider Performance Standards
To maintain service quality on the platform, MealApp sets minimum performance standards that riders must meet. Access to the platform may be suspended or terminated if a rider consistently falls below these thresholds:
- Minimum rating: riders must maintain an average customer rating of at least 4 out of 5 stars, based on feedback from delivery recipients
- Completion rate: riders must complete at least 70% of accepted orders. Repeatedly cancelling or abandoning accepted deliveries will result in a warning and, if continued, account suspension
Riders who fall below these standards will receive a warning via the Rider App. If performance does not improve within a reasonable period, MealApp reserves the right to suspend or permanently deactivate the rider's account.
Rider Insurance & Liability
As independent contractors, riders are solely responsible for taking out and maintaining adequate insurance coverage for all activities carried out during deliveries. This includes:
- Third-party liability insurance for the vehicle used (mandatory under Belgian law)
- Personal accident insurance covering injuries sustained while performing deliveries (recommended)
- Professional liability insurance if required under their self-employment category
MealApp does not provide any insurance coverage to riders. MealApp Technologies BV shall not be held liable for any accidents, injuries, property damage, or third-party claims arising during or in connection with a rider's delivery activities.
Rider Conduct
When performing deliveries on behalf of MealApp, riders agree to:
- Behave professionally and respectfully towards customers, restaurant staff, and MealApp personnel at all times
- Deliver orders to the correct address within a reasonable timeframe
- Keep food in appropriate conditions during transport (use of insulated bags is required)
- Not consume, open, or tamper with any order during delivery
- Verify the age of the recipient when delivering age-restricted products and refuse delivery if proof of age cannot be provided
- Comply with all Belgian traffic laws and regulations while performing deliveries
- Report any incidents, accidents, or issues immediately through the MealApp Rider App
Violations of these conduct standards may result in immediate account suspension and, where applicable, legal action.
Going Offline & Account Deactivation
Riders are free to stop working at any time. There is no minimum commitment or obligation to accept orders. To stop working on MealApp:
- Going offline temporarily: simply set your status to offline in the MealApp Rider App — you will stop receiving delivery requests immediately and can go back online at any time
- Stopping permanently: to fully deactivate your rider account, set your status to offline and uninstall the MealApp Rider App. Your account will be automatically deleted after 1 month of inactivity
- Any pending earnings at the time of deactivation will still be paid out on the next regular weekly payment date
- All personal data will be handled in accordance with MealApp's Privacy Policy following account deletion
Limitation of Liability
To the fullest extent permitted by Belgian law, MealApp shall not be liable for:
- Any indirect, incidental, or consequential damages arising from use of the platform
- Loss or damage caused by restaurant partners, delivery personnel, or third-party services
- Temporary unavailability or technical errors on the platform
- Inaccurate menu, allergen, or pricing information provided by restaurants
- Unauthorised access to your account resulting from your failure to secure your credentials
- Damages resulting from force majeure events including but not limited to natural disasters, pandemics, government restrictions, power outages, or strikes
MealApp's total liability for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim.
Force Majeure
MealApp shall not be held liable for any failure or delay in performance of its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to:
- Natural disasters, extreme weather conditions
- Pandemics, epidemics, or public health emergencies
- Government actions, laws, or regulations
- Power outages, internet failures, or cyberattacks
- Industrial disputes or strikes
In such cases, MealApp will notify affected users and partners as soon as reasonably possible and will resume normal operations as quickly as practicable.
Intellectual Property
All content on MealApp — including the logo, design, software, text, and graphics — is the exclusive property of MealApp Technologies BV or its licensors and is protected by Belgian and EU intellectual property law.
You may not reproduce, distribute, modify, or create derivative works of any MealApp content without prior written consent. Restaurant names, logos, and menu content remain the property of the respective restaurants.
By uploading photos or other content to MealApp, you confirm that you own the rights to that content or have obtained the necessary permissions to share it.
Governing Law & Disputes
These Terms & Conditions are governed by and construed in accordance with Belgian law. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Belgium.
As a consumer in the EU, you also have the right to use the European Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.
Changes to These Terms
MealApp reserves the right to update or modify these Terms & Conditions at any time. Users will be notified of material changes via email or in-app notification at least 15 days before changes take effect. Partner restaurants and riders will receive at least 30 days' notice for changes affecting commission rates, payout schedules, or partner/rider obligations.
Continued use of MealApp after the effective date constitutes acceptance of the updated terms. If you do not agree, you may request account deletion at team@mealapp.app.
